An arbitration agreement is an agreement between the parties to submit a dispute to an arbitration tribunal. An arbitration agreement may be concluded in the form of an arbitration clause in a contract or agreement, or as a separate written agreement.
If the arbitration agreement is concluded in the form of an arbitration clause, it is considered an integral part of the contract, and the same rules of succession that apply to the contract as a whole also apply to it. If the arbitration agreement is concluded as a separate agreement, in the event of a change of creditor in the obligation, the latter must notify the new creditor of its existence. Any amendment to the arbitration agreement in such a case is only possible with the express consent of the other party (or parties) to the agreement.
